1. Introduction

Welcome to A4Tool, operated by Throughout Technologies Pvt Ltd ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our HRMS application, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you do not have permission to access the Service.

2. Enterprise & SaaS Licensing

Our Service is a Software as a Service (SaaS) platform designed for HR management, payroll processing, and employee tracking. We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Service subject to these Terms and the subscription plan you select.

3. User Obligations and Acceptable Use

When creating an account and using the Service, you must provide accurate and complete information. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You agree not to use the Service:

• To violate any applicable national or international law or regulation, including the Information Technology Act, 2000 of India.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.

4. Application Features and Compliance

Our Service offers features such as attendance tracking, payroll calculation, statutory compliance (PF, ESIC), and desktop activity monitoring. By using these features, you, as an employer, represent and warrant that you have obtained the necessary consents from your employees as required by applicable laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act).

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Throughout Technologies Pvt Ltd and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

6. Limitation of Liability

In no event shall Throughout Technologies Pvt Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, specifically subject to the jurisdiction of the courts in Indore, Madhya Pradesh, without regard to its conflict of law provisions.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
